With Britney Spears laid up in a hospital under guarded supervision following Thursday night's craziness, OK! spoke to Judge Lynn Toler to get her professional opinion of the troubled star's odds of regaining custody of her two boys, Sean Preston, 2, and 1-year-old Jayden James.

Not surprisingly, Judge Toler tells OK! that it's going to take a lot for Britney to prove that the events of last night, which saw the involvement of dozens of police and a handful of ambulances, was nothing more than a momentary lapse in judgement. "That's a hard sell," the judge warns. "If she breaks under those stresses, then the court will err on side of caution."

"You hate taking kids away from their mother," Judge Toler adds. "It's unfortunate that all these things have happened, but the bottom line is the children."

The judge also tells OK! that these kinds of breakdowns aren't rare occurrences in custody disputes. "They are more common than you think," she explains. "I actually watch a lot of hearings in Arizona about these sort of cases. That's why you have all those new laws about child stealing as opposed to kidnapping."

So what are Britney's chances of having little Sean and Jayden back in her arms in the near future? While Judge Toler isn't sure if Brit will ever regain custody, she admits, "anything can happen."

"The cumulating evidence: The substance abuse, the legal troubles. All of those have accumulated to such an extent that, I don't want to say she can't, but it would be extraordinary if she didn't have supervised visitation at best."
