Sure, Modern Family is one of the hottest comedies on TV but when it comes to its star Ariel Winter, there's no laughing matter.

The 14 year-old will temporarily remain in the care of her adult sister, Shanelle Gray, because a Department of Children and Family Services report to the court found evidence of emotional abuse. While the report indicated Chrisoula Workman emotionally abused her daughter, the report found "unsubstantiated" claims of allegations regarding physical abuse.

Chrisoula's attorney argued that 34 year-old Shanelle was an unfit guardian because she's "too young" and "has her own family to deal with."

That said, as pointed out by People, L.A. Superior Court Judge Michael Levanas indicated Ariel's older sister said "eloquent things" at a previous hearing and indicated the family needed to heal.  Keep in mind Ariel's parents have been separated for a while and to add another dimension, her father suggested he move into the family home while Chrisoula moved out.

The judge rejected that suggestion and claimed he had "questions about the nature and strength of the relationship with her father."

Apparently after the hearing, Chrisoula stated, "I love my daughter and I just want our family to be back together and for everyone to pray for my family."

A trial date has been set for December 12 to see where Ariel belongs.
