Lindsay Lohan is "tired of people lying in order to score a quick paycheck" and plans to sue the man who claims she "smelled like alcohol real bad" during last week's hit and run in NYC.

After leaving Chelsea's hip nightspot, Dream, last Wednesday, Lindsay clipped cook, Jose Rodriguez, with her Porsche. Instead of stopping, the troubled actress zoomed away to her hotel room, which scored her a tidy misdemeanor hit and run charge.

While Lindsay, her equally troubled father, Michael Lohan, and even the cops, claim she wasn't drinking at the time, Jose told reporters and authorities that the Mean Girls actress was slurring her words.

Since La Lohan just loves the courtroom, newest reports indicate she's planning to sue Jose for defamation.

With roles in Scream 5, The Canyons and Liz and Dick, the actress is telling pals she's just beginning to get her feet back on the groud. The last thing she needs is boozy rumors flooding the Internet.

“We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue,” Steve Honig, her representative, told the NY Daily News.

Good luck, Linds.
