Will Tom Cruise Let Katie Holmes Take Suri Away From Scientology in the Custody Battle?

Tom Cruise and Katie Holmes severing their marriage is really only the tip of the divorce iceberg. The bigger question? Who will get sole custody of Suri and will their six-year-old spawn continue to practice Scientology?

As everyone knows, Tom is a passionate Scientologist and Katie never really got onboard. In fact, it's rumored a big reason for their upcoming divorce is how they ideologically clash when it comes to religion. Katie was raised Catholic and wants Suri to have a more traditional (read: not Scientologist) childhood and upbringing. She believes Suri won't enjoy a wide circle of friends and "good schooling" under the helm of Scientology.

Tom on the other hand is adamant his children be raised under the teachings of L. Ron Hubbard and will likely fight to the death for this.

"Tom will move Heaven and Earth to ensure Suri stays a Scientologist, at least until she is of an age to make a decision to leave on her own accord. But until then, make no bones about it, Suri will be raised within the church," a source told RadarOnline.com.

As disgusted as Katie might be with the church and their idiosyncrasies, legal experts say Scientology alone will not grant her full custody and will only be considered relevant if certain practices prove harmful. Otherwise, a court probably won't intervene in the name of religion.

"It’s only relevant if it impacts the decision making of the parents," New York-based family law attorney Bernard Clair said. "Just the fact that Tom is a Scientologist should not matter."
