Joe, 47, got a lucky break when the United States Court of Appeals for The Third Circuit ruled that he does not need to be sent back to Italy while the case is still ongoing.
The father of four has been in custody at an immigration detainment center since his release from prison on March 14, 2019. He served 41 months for fraud. His legal team is reportedly working on getting him out of custody as he awaits the verdict.
Joe filed an appeal to stay in the U.S. in November 2018 after a judge ordered his deportation to Italy, but sadly it was denied.
The businessman is now using his last chance to appeal the denial before the federal courts make their final decision.
Teresa, 47, and her daughters Gia, 18, Gabriella, 15, Milania, 14, and Audriana, 10, haven't been able to see Joe since his release from jail. They recently penned heartbreaking letters to plead with the judge to rule in their favor.
"Judge Ellington, my daughters need their father. They cry for him every day ... I cannot bear the thought of my daughters losing their father. I am fearful that it will break them and that I alone will not be able to fix them. Judge Ellington, this is my greatest fear and it keeps me up at night. The fear that if I lose my husband, I will also lose my children, as they will never be the same," Teresa wrote in court documents obtained by RadarOnline.com.
