Chris Soules Accused Of ‘Hiding Level Of Intoxication’ In Fatal Hit-And-Run Crash
Was Chris Soules drinking and driving the night of his deadly car crash? Well, according to the State of Iowa is on a mission to find out.
In court documents, obtained from Iowa District Court for Buchanan County by Radar, the State of Iowa claims the court has already determined that there is “probable cause to believe that an offense has been committed and the defendant committed it’ at the Defendant’s initial appearance on April 25, 2017.”
As OK! reader’s know, Chris was arrested last week after allegedly slamming his pickup truck into the back of a tractor-trailer, killing the driver, before fleeing the scene after calling 911. The 35-year-old reality star was charged with leaving the scene of a fatal car accident that left one individual dead.
The State’s filing comes just one day after Chris’ attorneys filed to dismiss the hit-and-run case on the basis of the reality star’s 911 call.
“Mr. Soules described the location of the accident and communicated with dispatch for approximately 5 minutes and 45 seconds while help was en route,” Chris’ lawyer’s May 1st filing read. “The evidence will further show that emergency responders arrived on the scene shortly after Mr. Soules concluded his 911 call. Mr. Soules remained on the scene with those emergency responders for several more minutes before returning to his home.”
However, The State is calling the motion filed by the reality star’s legal team to dismiss the case “premature.”
“Defendant’s motion to dismiss recognizes the defendant was to immediately return to the scene of the accident or inform the law enforcement authorities where he could be located,” the May 2nd filing read. “Defendant did neither. Furthermore, the only permissible reasons for which Defendant could leave the scene of the accident in the first place was to seek necessary aid or report the accident to law enforcement authorities. Defendant did neither after fleeing the scene.”
The State is not only sure that they have a case when it comes to Chris fleeing the scene of the accident, but they also believe he tried to hide how much he had been drinking the night of the crash.
The State alleges Chris attempted “to obfuscate the immediate facts and circumstances surrounding the accident, including a determination of his level of intoxication and an explanation of the empty and partially consumed open alcoholic beverages located in and around his vehicle that he was seen purchasing at a convenience store shortly before the accident.”
As OK! readers know, The Bachelor star was actually sentenced to jail for a driving under the influence, back in 2005.
And with Chris’ filing to dismiss still on the table, The State is asking the Court to deny his motion without a hearing.
