Fights over business, an anemic sex life and fuming walkouts — anyone who's followed this season of Bethenny Ever After... has wondered how long before Bethenny Frankel and husband Jason Hoppy call it quits.

Star has learned that not only have both parties visited divorce lawyers, but an eyewitness source also saw Bethenny cavorting with none other than Matt Hesse, her business partner — as recently as three months ago.
According to the source, in February Bethenny entered Philippe Chow's Philippe restaurant in NYC hand in hand with Matt — looking more like a hot and heavy couple than work associates.
"They walked through the restaurant with his chest pressed up against her back, and she leaned back and he whispered in her ear," says the source. "Then they went up the stairs to a private dining area together, literally with their arms wrapped around each other."

Although Bethenny has openly admitted to having marital issues, both to the press and on her show, she's never mentioned having a relationship with her Skinnygirl business partner.

"Jason has said that when he is ready to officially file for divorce, he is ready to call Bethenny out on her infidelity and name Matt in the papers," said an insider. Matt has stated the relationship with Bethenny is strictly professional.
