David was pulled over by the Florida Highway Patrol around 8 p.m. after he was reportedly weaving on and off the road, TMZ reports.

Cops reportedly discovered a half empty bottle of bourbon and David blew a 0.139 and 0.141 when he was given a breath test.

David reportedly told police he had a glass of wine with his lunch and took a hydrocodone painkiller a few hours prior to his arrest.

He was released at 3:22 a.m. this morning on a $350 bond, but now he plans to fight the charges.

The 60-year-old star is also reportedly arguing against the breathalyzer tests he took saying his blood alcohol content was not accurately measured.

David's rep says he is looking for a lawyer and "He would never jeopardize anyone on the road and he would not have been driving had he not had to go to a funeral ... he's never been arrested in his life before for anything."
