Last week, David's nephew Nicholas Peloquin (who also goes by Nicole) claimed he felt his breasts at a hotel gym in Florida during a workout.
The Oscar-nominated director didn't deny the claim, but said it was consensual.
Now, E! News has confirmed through the Media Relations Director for the Broward County (Fla.) Sheriff's Department that David will not face criminal charges.

If Nicholas, however, wants to continue the case he'd have to go to the Florida State Attorney's office now.
