Lindsay Lohan is being sued for negligence over an Oct. 4, 2005, accident in which her Mercedes-Benz hit a van and injured the driver, Raymundo Ortega.
Ortega alleges that Lohan had been drinking prior to the accident at the Ivy Restaurant, even though she was underage.
But in a Dec. 15 declaration — filed on Dec. 21 — Lohan stated that "I did not consume an alcoholic beverage or any type of medication or drug" either before or during her restaurant visit. The declaration included a statement by Adam Novicki, the Ivy waiter who served Lohan, who stated that she did not order alcohol.
In response to his claims, Lohan has countersued Ortega, citing a California Highway Patrol report that said he was at fault for the crash because he made an illegal U-turn.
