Lindsay's Lawyer: She's on Track to Sobriety

On New Year's Eve, Lindsay Lohan, who claimed to have gone clean and sober following an extended stay at the Cirque Lodge rehab clinic in Utah, was photographed doing the one thing a sober person doesn't do — drinking. The 21-year-old was in Capri, Italy, where she was caught on video swigging from a bottle of champagne at a Dec. 31 party.
And now, in a statement released by her lawyer, Blair Berk, La Lohan's people are claiming it was just a speck of dust on an otherwise clean record. "After being handed a champagne bottle while on a dance floor in Italy on New Year's Eve and drinking from it, the good news is that Lindsay immediately stopped, called her sponsor and got herself back on track .'There is no magic cure here.''

In her first and photo shoot after leaving rehab in October, Lindz told OK! about her time at Cirque, "It was a sobering experience... It made me look at myself and all the people, places and things in my life in a different way."
