The right place for surrogacy abroad is the one that fits your own circumstances. Five criteria will help you decide:

  • the legal status of the procedure,
  • the availability of the program for your family situation,
  • the level of reproductive medicine,
  • the budget,
  • the requirements of your country of citizenship.

Today, three countries are primarily open to foreign intended parents — Ukraine, Georgia and Mexico. Each has its own way of establishing parentage and its own prices. Below we look at them in more detail, so that you can see whether these countries' requirements match your situation.

What the Choice of a Country for Surrogacy Depends On

Countries for surrogacy are most often compared by budget, although in practice legal conditions — for example, the exclusion of same-sex couples — can make the circumstances unfavourable even with an ideal budget. That is why the criteria are worth considering as a whole.

Legal regulation and the way parentage is established. In some places, parents are entered on the birth certificate administratively; in others, a court decision is required. This affects the timeline and the number of documents.

Availability for your family situation. Some jurisdictions work only with married couples with medical indications, while others admit a wider range of intended parents.

The development of reproductive medicine. Modern methods, the necessary equipment, experienced doctors and a large number of in vitro fertilization programs performed all increase the chances of success.

The program budget and cost transparency. What matters is not only the amount, but also how precisely it is set out what is included and what is paid for separately.

The requirements of your country of citizenship. These determine how your child will receive their documents and how your parenthood will be recognized at home.

The ideal option is when none of the criteria present insurmountable obstacles — since some issues can be resolved with additional documents and procedures.

Countries Where Surrogacy is Available to Foreigners

Ukraine

The procedure is regulated at the level of law: the use of assisted reproductive technologies is governed by Order No. 787 of the Ministry of Health, and Article 123 of the Family Code sets out the path for recognizing the child's descent. Parentage is established administratively, without a court.

Programs for surrogacy in Ukraine are available to Ukrainian and foreign married couples with medical indications. The process costs approximately €46,000–60,000 depending on the scope of support, plus extra costs under the contract that arise if needed (repeat embryo transfer, genetic testing, accommodation, twins).

Advantage: the parents are entered on the birth certificate immediately, and the surrogate has no rights to the child.

Georgia

The legal basis is the Law of Georgia "On Public Health Care", which permits the use of assisted reproductive technologies, including gestational surrogacy. The intended parents are recorded as the parents in the child's documents.

Programs for surrogacy in Georgia are available to married couples. If the marriage has lasted less than a year, an additional document confirming at least one year of living together will be required — for example, registration at the same address, a marriage contract or joint property. The cost is €44,000–62,000. The amount depends on the scope of the medical procedures, the number of embryo transfer attempts and additional services.

Advantage: programs are carried out in Tbilisi, so the preparation, pregnancy management and paperwork are concentrated in a single city, which makes travel easier to plan.

Mexico

There is no single federal law — the matter is regulated at state level and through case law. In February 2026, the Supreme Court of Mexico established a mandatory procedure for states without a specific law: the surrogacy agreement is notarized and reviewed by a judge, and after the birth the judge orders the birth certificate to be issued.

The range of intended parents here is wider: programs are available to married couples, single parents and same-sex couples. The budget is $56,900–191,900. The lower end is a program with ready embryos; the upper end is a program with two surrogates at once, designed for the birth of two children.

Advantages: the court decision on parentage is usually issued before the child is born, and all processes are geographically concentrated in Cancún, where most programs take place.

Surrogacy for foreigners in all three countries consists of the same steps: signing the contract, medical procedures, pregnancy support and obtaining the child's documents. What differs is the mechanics and the content of these steps. The exact budget is calculated individually depending on your couple's needs, but always within the stated range for the program.

Why Your Own Country's Legislation Matters Just as Much

For your child to receive citizenship in your home country and to travel home with you without difficulties, all local conditions will have to be met. The paperwork begins before departure and continues in your country of residence.

In some states, consular registration of the birth and legalization of the Mexican, Georgian or Ukrainian certificate is enough. In others, recognition of parenthood follows a separate procedure and requires additional legal steps once you are home.

All the steps are discussed with the program's lawyer before the contract is signed, and the decision is made on the basis of whether the legal requirements can be met.

A practical algorithm: how to choose a country step by step

  1. Obtain a medical opinion confirming the indications for surrogacy.
  2. Find out what your country of citizenship requires for establishing parentage and issuing your child's documents.
  3. See which country is available to you within your budget (add 10–15% to the range for additional costs).
  4. Compare 2–3 jurisdictions in terms of conditions and convenience for your couple.
  5. Check the clinics' licences and the agencies' experience, and ask for sample contracts.
  6. Clarify exactly what is included in the program and what is paid for separately, and find out the payment methods.
  7. Find out who accompanies the family at the stage of obtaining the documents for departure in each country, and how.

Surrogacy for foreigners is always a combination of the legal requirements of two countries, medical needs, financial means and expectations regarding the level of comfort. That is why every family has its own answer to the question of where it is best to go through a program.
