RadarOnline.com revealed that she filed a Motion to Modify Custody with the court, asking for “sole physical custody” of the toddler.

According to documents, the mother-of-two's attorney wrote, “Defendant communicated to plaintiff that defendant’s mental health is not stable and that he is unable to care for the minor child."
Also stated in the documents, Nathan "communicated to plaintiff that he has plans to move out of the country in the near future.” Adding, “Defendant has multiple pending criminal charges.”

“Plaintiff is informed and believes that defendant has a substance-abuse issue and is unable to care for the minor child during defendant’s visitation,” the documents state.
