According to TMZ, Heather was cited for a hit-and-run and not taken into custody.
However, a Ventura County Sherriff's Department official told TMZ that type of citation is considered an "arrest."
At about 4 a.m., law enforcement sources said someone heard a crash near Heather's home in Westlake Village, Calif., TMZ reports.
But the person didn't contact the Ventura County Sheriff's Department until 7:48 p.m. that night.

A "no parking" sign was found knocked over and signs of a car (later confirmed to be Heather's black BMW) going over the curb were noted.
After going to her home and looking at her car, deputies saw damages consistent with the accident.
Heather was arrested for a hit-and-run, which is a misdemeanor — meaning she was cited and then released.

OK! NEWS: HEATHER LOCKLEAR ESCAPES DUI CHARGE
In 2008, Heather pleaded no contest to a misdemeanor charge of reckless driving and received three years informal probation.
TMZ reports a Santa Barbara prosecutor is looking into her recent accident as it could be a violation of her probation.
Blair Berk, Heather's lawyer, told TMZ, "Ms. Locklear was cited with a misdemeanor traffic ticket as she is the registered owner of the vehicle. She was never taken into custody. The matter is still being looked into as it is not yet clear who was driving the vehicle."
