Gambino Crime Boss John Gotti's Grandson Enters Prison After He Was Denied More Time to Give Dying Mom a Kidney

Carmine Agnello, the grandson of late Gambino crime boss John Gotti, surrendered to the federal Bureau of Prisons on Monday, August 10, after U.S. District Judge Nusrat J. Choudhury denied his third request to delay his reporting date to donate his kidney to his dying mother.

He reported to the federal prison camp at FCI Fairton in New Jersey to begin serving his 15-month sentence.

Agnello's team had previously secured a two-month delay on his original June prison report date so he could donate a kidney to his mother, Victoria Gotti, who suffers from end-stage renal failure. The surgery was initially scheduled for August 3 but was postponed.

Victoria, 63, requires an urgent kidney transplant to avoid permanent, lifelong dialysis. While Carmine is a compatible blood match to be her living donor, the procedure has been repeatedly delayed and derailed by ongoing medical issues.

Agnello, 40, was sentenced after pleading guilty to wire fraud for illegally obtaining $1.1 million in COVID-19 small business disaster relief loans, which he then spent on cryptocurrency.

Agnello’s defense sought another extension, asking the court to delay his prison surrender until September 18 so he could remain available to donate his kidney if Victoria was cleared for surgery.

However, federal prosecutors presented medical reports showing that Victoria had suffered recurrent infections, preventing doctors from scheduling a new surgery date. A judge ultimately denied the request, and Agnello reported to prison on August 10.

Judge Choudhury ruled that because no transplant surgery was actually imminent, further delaying Agnello’s sentence was "unjustified."

His defense attorney, Robert Beltrani, argued that forcing Agnello to surrender now could effectively disqualify him from being a living donor if his mother’s health improves and she is cleared for surgery in the coming weeks.

The mafia daughter, author and former Growing Up Gotti reality star has faced chronic health issues since her 20s, including mitral valve prolapse (MVP) and a leaky heart valve.

Her kidney health began deteriorating significantly around 2021, when her blood levels became severely elevated. She has since progressed to advanced chronic kidney disease.

The primary reason the transplant did not happen before her son’s prison report date was a severe infection.

Her doctors noted that she is currently undergoing intensive treatment with a "battery of antibiotics," and the transplant cannot be safely performed until the infections are fully cleared.

In letters submitted to the federal court pleading for leniency for her son, Victoria referred to Carmine as her "miracle child" and thanked him for offering her the gift of life.

Earlier in the legal proceedings, Victoria emotionally stated that she did not want to accept her son’s kidney if he would be forced to undergo the painful recovery process while incarcerated in a federal prison.

She also expressed deep concern about whether the Bureau of Prisons could provide the strict, hygienic follow-up care required for a living organ donor.
