Kim Zolciak’s 15-Year-Old Son Kroy Jr. Officially Indicted on Sexual Assault Charges as He Seeks Release From Atlanta Jail

Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., was indicted on seven felony counts on Thursday, September 3, in Fulton County, Ga. The charges stem from an alleged April encounter involving a female classmate at a fitness center in Alpharetta.

The indictment came one day after KJ’s attorneys asked a judge to release him on bond. The teenager has denied the allegations, as has his mother, and remains in custody while the case proceeds.

According to an indictment obtained by TMZ, KJ faces charges of aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of sexual battery against a child under 16.

The charges stem from an alleged April 23 encounter involving a 15-year-old female classmate. Authorities allege KJ restrained the teenager and subjected her to nonconsensual sexual acts inside a family changing area at a Life Time Fitness location.

Although KJ is 15, authorities are handling the case through Fulton County Superior Court.

Police opened an investigation after an officer responded to North Fulton Hospital on April 24, one day after the alleged encounter. The teenager underwent an examination at Children’s Healthcare of Atlanta, where medical staff completed a sexual assault kit.

An arrest warrant stated that testing did not identify male DNA, according to FOX 5 Atlanta. KJ’s defense has highlighted that finding while disputing the allegations against him.

Alpharetta police arrested KJ on Aug. 17 and initially charged him with aggravated sodomy and aggravated sexual battery. Authorities subsequently detained him without bond at the Metro Regional Youth Detention Center.

KJ’s attorney, Jason B. Sheffield, filed a petition seeking his release while the criminal case moves forward. Sheffield's filing argues that the teenager isn’t a flight risk and points to his academic, athletic, and personal background as evidence of his character.

According to Page Six, the defense cited KJ’s academic performance, football accomplishments and athletic scholarship opportunities.

"His ties to his family and community are substantial. His parents live separately, and he maintains a home and relationship with each," court docs asserting his good behavior read.

His attorneys also highlighted his relationships with his parents, five siblings, teachers, coaches and friends. They noted that KJ learned about the allegations in April but remained in Georgia during the investigation.

"Beyond his immediate family, he is surrounded by an established community of extended family, friends, coaches, teachers and others who remain actively involved in his life and continue to support him and his family during the pendency of these serious allegations," they said.

Sheffield has also asked the court to keep the proceedings confidential because KJ and the other teenager are minors. The defense cited the extensive media coverage surrounding the case as another reason to restrict public access.

KJ’s status as the son of Zolciak, a former star of The Real Housewives of Atlanta, has drawn national attention to the allegations.

Zolciak's son denied the allegations, describing them as “reckless and deeply troubling,” and said KJ denied engaging in the alleged conduct.

The reality television personality also cited the polygraph examination and DNA findings while asking the public to allow the legal process to continue. KJ’s father has not publicly addressed the indictment.

KJ’s next court hearing is scheduled for September 8 at 1 p.m., according to FOX 5 Atlanta. From there, a judge will determine whether to grant bond and whether the case details will remain confidential.
