It was a much different environment for Bethenny and Jason while they were in court on Monday, as Judge Michael Katz denied his request to order drug & alcohol testing for her in their seemingly endless financial, legal and custody battle.

Judge Katz said that there wasn't enough sufficient evidence to order it, even though his lawyer claimed that she abused both Ambien and alcohol. He also slammed Jason in his attempt, saying "I think you are trying to exploit Ms. Frankel to embarrass her. The appeal is denied.”
