'RHOBH' Star Erika Jayne Dismissed From Ongoing Lawsuit Against Ex-Husband Tom Girardi, Lawyer To Refile In California
Dismissed...but the fight isn't over.
A judge has ruled that Erika Jayne has been dismissed from the ongoing fraud and embezzlement lawsuits against her ex-husband Tom Girardi, but that doesn't mean things will be smooth sailing for The Real Housewives of Beverly Hills star.
“Pursuant to stipulation, plaintiff’s claims against defendants EJ Global LLC and Erika Girardi are dismissed without prejudice and without costs,” the Saturday, January 29, court documents read per Page Six. This decisions comes shortly after both parties mutually agreed that Jayne's “dismissal is appropriate.”
But according to attorney Jay Edelson — who originally filed the suit against Girardi — the fight isn't over.
"The suit is being refiled in California (to avoid fights over jurisdiction)," Edelson stated in a tweet. "No chance we are letting @erikajayne off the hook, especially given the evidence we have found. All money will go fully to the victims until they are made whole."
The "Pretty Mess" singer, 50, and her embattled ex-husband, 82, had only recently filed for divorce in November 2020, when they were bombarded with multiple lawsuits accusing Girardi of embezzlement and fraud.
The alleged victims accused the high profile lawyer of purposefully stealing money from a fund meant for families of victims of the Lion Air plane crash that occurred in 2018 in order to pay for his and Jayne's "lavish lifestyle."

Edelson law firm — who worked closely with Girardi on the plane crash settlement case — also claimed to have proof that “money that belonged to the surviving widows and orphans of the victims of that plane crash had, in fact, been used to make payments for Erika or her companies.”
The pair was later accused of staging their divorce as a plan “to fraudulently protect Tom’s and Erika’s money from those that seek to collect on debts owed by Tom and his law firm GK.”
In January 2021, Girardi and his firm Girardi Keese were ordered by Judge Barry Russell into Chapter 7 bankruptcy. Several months later, he was suspended by California federal courts from practicing law.
Things only got worse for the RHOBH star in July, when a judge decided that Girardi's clients could attempt to collect money owed from Jayne, citing that her ex's firm had given the Bravolebrity nearly $20 million in loans.
As the blonde beauty awaits the refiling process in the rollercoaster legal battle, she may still have some friendships to patch up along the way.
As OK! previously reported, fellow housewives Garcelle Beauvais and Sutton Stracke unfollowed the pop star on Instagram this past week.
“Garcelle has been coming for Erika this season,” a source spilled. “A couple nights ago, while filming, they really got into it with each other.”
