Josh Duggar is demanding that a lawsuit filed against him in California be dropped, arguing that he cannot be sued in the state! The lawsuit was filed by Matthew McCarthy, a California DJ who claims the former reality star stole his photo and used it on his Twitter, OKCupid, and Ashley Madison accounts to have affairs. While Matthew alleges Josh’s use of his pic caused him to lose gigs and receive nasty messages, Josh claims he never had contact with anyone in California through the sites, and therefore, the lawsuit should be tossed!

While Josh acknowledges he’s visited California twice, he claims neither visit was related to the sites where he allegedly used Matthew’s photo.

“Duggar's two visits here in 2013 and 2015 have nothing to do with McCarthy's claim that Duggar used his picture on the internet. Neither involved contacts related to this lawsuit,” court documents obtained by the Daily Mail state.

In May, Josh was issued a summons to appear in court in Los Angeles, but Josh has filed a motion to dismiss the summons.

“If a visit to California creates jurisdiction, then California courts have jurisdiction over virtually everyone in the United States,” the motion read.

Josh’s Ashley Madison account was uncovered in 2015. The site marketed itself with the slogan, “Life is short. Have an affair.” Josh later admitted to cheating on his wife Anna and even confessed he had a pornography addiction (which he later removed from his statement).
