"I'm taking him to court to get full custody," she added. "I want him to still see her, but I want him to take drug tests."

Ryan was five hours late for Jamie's labor, and Jamie says he was late because he was "sleeping with someone else."

"He can be with whomever he wants to be with," Jamie said, adding, "I mean, I love him. I hate him. I would never be with him."

And TMZ reports that Jamie has filed court documents in North Carolina, claiming Ryan is "not responsible and not in a position to provide a stable environment" for their 7-month-old daughter, and is filing for sole custody.

Reportedly, she also claims that Ryan has a "history of driving while under the influence of alcohol" and a "history of cocaine abuse."

Their court date is set for June 13. Ryan told TMZ, "She's doing this just to cause problems... it will all clear out in court."
