Breaking the rules! Hilary Duff's eldest daughter, Banks, 3, was spotted riding around with her Younger costar Molly Bernard when fans couldn't help but notice that she should be in a car seat.
According to California law, any child under 2 has to be in a car seat until they are either 40 pounds or more or 40 inches or taller, meaning that Banks would have to be in a booster seat or car seat.

"you heard the girl @alyssaedwards_1 @rupaulsdragrace @hilaryduff @matthewkoma next up: backrolls," Bernard captioned a video and a slew of photos of the two of them in the back of a vehicle.
But many concerned fans took to the comments section to call out the actress, 34.
One person wrote, "She is so cute!!!!! But why is she not in a car seat😬😬😬😬😬, it is the law for a child her age," while another added, "Why isn’t she strapped in safely 😥."
A third user stated, "She adorable but shouldn’t she be in a booster seat?"
This is hardly the first time Duff has been mom-shamed. In 2019, she pierced Banks' ears, and people were not happy with her decision.
“She has enough hair for a pony. Oh and yes we pierced her ears,” the blonde babe wrote via Instagram at the time.

“I can’t fathom why you would you think it’s OK to have your daughter’s ears pierced. Causing her a tremendous amount of pain and discomfort,” one person fumed.
One user defended Duff, writing, "Parents have been doing this for YEARS! It’s not painful and not a big deal so back off! Do what you will with your own child.”

In November, the Younger alum decided to pierce her daughter Mae's ears — but this time around, she was ready for the backlash.
“Yes! I pierced her ears today,” she captioned a photo of her tot rocking her new earrings. “Can’t wait for the internet to call me a child abuser … again. Lesss go.”
